Privacy Policy

This document explains how VisaAffairs (Visa Affairs Pty Ltd) collects, uses and protects your personal information under the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth).

1. Overview

VisaAffairs is an Australian migration advisory practice operating under the supervision of the Office of the Migration Agents Registration Authority (MARA). We comply with:

  • Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs).
  • Migration Agents Code of Conduct (Regulation 8AA).
  • Confidentiality obligations arising from the migration agent — client relationship.

2. Information we collect

When you interact with our website or services we may collect:

Via the free assessment form (/en/danh-gia/)

  • Full name, email, phone (if you provide it).
  • Nationality, current location, age.
  • Visa of interest, English level, qualification.
  • Background info (job offer, sponsor, partner, prior study in Australia).
  • Personal situation description (if you provide it).
  • Best time to contact and preferred contact method.

Via the self-assessment quiz

  • The self-assessment quiz does NOT collect personal information (PII). Answers are kept temporarily in browser memory and discarded when you close the tab.

Via web analytics

  • VisaAffairs uses Cloudflare Web Analytics — a privacy-first solution that does not use cookies and does not identify individual users. Data collected: page views, browser, country (IP geo, raw IP not stored).

When you book a consultation

  • Information needed to schedule and run the consultation (name, email, calendar slot).
  • During the consultation: detailed information about your visa file.

3. How we use your information

We use your information to:

  • Respond to free assessment requests and consultation bookings.
  • Provide migration advisory services if you sign an engagement letter.
  • Contact you about important updates relating to your file.
  • Comply with Registered Migration Agent obligations (file retention minimum 7 years per OMARA requirements).

We do NOT use your information for third-party marketing, do not sell data, and do not run retargeting.

4. Sharing with third parties

VisaAffairs shares your information only in the following cases:

  • Department of Home Affairs — when necessary to lodge a visa application on your behalf, after you sign an engagement letter.
  • Third parties you request — such as English testing centres, panel doctors, education providers — when necessary to support your application.
  • Legal requirement — when Australian law requires disclosure (court order, OMARA investigation).

We do NOT share your information with marketing partners, ad networks, or any third parties outside the above without your explicit consent.

5. Data retention

  • Assessment forms (no engagement signed): kept up to 12 months, then deleted if you do not become a client.
  • Client files (engagement signed): minimum 7 years per OMARA requirements, then securely deleted.
  • Email and contact: kept in VisaAffairs' secure mail system (Google Workspace with mandatory 2FA).

6. Data security

  • All accounts with access to client data are protected by 2FA.
  • Data is stored in services that comply with Australian privacy laws.
  • Access is restricted to the Registered Migration Agent and authorised personnel.
  • We never request passwords via email or other unsafe channels.

7. Your rights under the APPs

Under the Australian Privacy Principles you have the right to:

  • Access the personal data we hold about you.
  • Request correction if the data is wrong.
  • Request deletion (unless retention is required by law).
  • Withdraw consent at any time (this may affect our ability to continue services).
  • Complain to the Office of the Australian Information Commissioner (OAIC) if you believe VisaAffairs has breached the Privacy Act.

8. Cookies

VisaAffairs does not use tracking cookies. Cloudflare Web Analytics is cookie-free. Your browser may store a few technical cookies (e.g. language preference) but they do not identify you personally.
